The protection of the data related to you (“Personal Data”) is very important to Valyo Ltd, which is why we work to ensure responsible handling of your Personal Data and comply with legal requirements at all times.
This Data Privacy Statement (“Data Privacy Statement”) provides information about how we process your Personal Data.

2. COLLECTION AND PROCESSING OF PERSONAL DATA 
We primarily process Personal Data that we collect when you visit our website or use our platform as well as the Personal Data that we obtain directly in the context of our contractual relationship with you. Specifically, we collect Personal Data that includes, but is not limited to, the following:
• Contact details (such as your first name/surname or company name, address, email address, telephone number)
• Account/agreement number, other account information
• Marketing data (such as preferences, risk and investment profiles, transaction data, requested information)
• Data collected when you access the content of the website/platform (such as the date and time the website/platform is accessed; IP address, host name of the accessing computer; website from which the website was accessed; websites accessed via our website; page(s) visited on our website – regarding use of the website, also see para. 6 below)
• On behalf of the designated paying agent, if necessary: Data to identify the contractual partner, determine the controlling person and/or the beneficial owner in accordance with applicable anti-money laundering legislation (e.g. certified commercial register extract, certified copies of forms of identification, etc.) as well as data for the purpose of determining whether there is an active client relationship with the paying agent.
You warrant that the Personal Data that you make available to us has been collected and provided in compliance with the applicable data protection laws.
To the extent permissible, we also collect certain Personal Data about you from publicly available sources (e.g. debt collection registers, land registries, commercial registers, media, the Internet).


3. PURPOSES OF DATA PROCESSING
The Personal Data is used within the legally permitted framework for:
• Disclosure of companies that participate on the platform, for advertising purposes
• Optimisation, enhancement and management of our platform and services;
• Administration of client and usage data;
• Collection of anonymised statistical data (e.g. platform behaviour);
• Advertising and marketing (including conducting events), provided you have not objected to the use of your data (if we send you, as an existing client, advertising, you can object to this at any time and we will add you to our advertising opt-out list);
• Market and opinion research, media monitoring;
• Assertion of legal claims and defence in connection with legal disputes and official proceedings;
• Prevention and clarification of criminal actions and other wrongdoings (e.g. conducting internal investigations, analysing data to combat fraud)
• Ensuring our operations, particularly IT services, our website and other platforms
• On behalf of and for the purpose of disclosure to the paying agent, if necessary: To determine whether there is an active client relationship with the paying agent as well as to subsequently identify the contractual partner, determine the controlling person and/or the beneficial owner of the contractual partner or the relevant assets in accordance with applicable anti-money laundering legislation.


4. THIRD PARTY DATA DISCLOSURE AND DATA TRANSMISSION ABROAD 
Personal Data is only disclosed to employees of Valyo or third parties who need this data for the above-mentioned purposes. Personal Data is only disclosed to third parties as permitted by law. Any service providers are contractually obliged to process the data they receive confidentially and are bound by the applicable data protection laws. Data is not sold to third parties for marketing purposes.
Valyo may disclose Personal Data to the designated paying agent and may exchange information with it in order to enable it to comply with its obligations relating to financial market legislation, in particular regulations relating to combating money laundering and terrorism financing as well as national or international sanctions, in the course of preparing or carrying out transactions.
Some of the recipients of the Personal Data are located in Switzerland, but they may be located in any country in the world. If we disclose Personal Data to a country that does not have adequate data protection laws, we ensure, as legally required, an adequate level of protection through the use of corresponding agreements (i.e. on the basis of the European Commission’s standard contractual clauses) or binding corporate rules, or rely on your consent.
 

5. PROFILING 
We may from time to time process your Personal Data in accordance with paragraph 2 with the aim of evaluating certain customer characteristics and creating a profile from such characteristics. In particular, we use such profile to advise you optimally, to tailor sales and marketing to your individual needs and to conduct market research. This includes the preparation and provision of tailor-made services, taking into account current and future customer needs and behaviour as well as identified customer, market or product potential. These can be used in customer care, consulting, direct marketing or in print and online advertising.


6. EMAIL COMMUNICATION
When users access the Valyo website and contact Valyo via electronic means their data is generally transmitted via an open network that is available to anyone. In addition, the data may in some cases be transmitted across national borders, even if both the sender and the recipient are in the same country. Even if the individual data packets are encrypted, the sender and recipient remain unencrypted. As a result, it cannot be ruled out that the transmitted data will be viewed by third parties and that the contact with Valyo can be tracked.
Thus, the security of data transmitted by email cannot be guaranteed. Confidential information should therefore not be sent by email. If you send strictly confidential information via an open network, you do so at your own risk.


7. COOKIES AND WEB ANALYSIS SERVICES
7.1. DEFINITION

When you access a website small files known as cookies are stored on your device. This data can be used by the operator of the website to read information and make their websites more user-friendly and secure.

We process and save your Personal Data for as long as required to fulfil our contractual and legal obligations (in particular document retention and documentation obligations) for other purposes pursued with the data processing as well to the extent necessary to safeguard legitimate business interests (in particular, for evidentiary purposes during the statutory period of limitation).


9. DATA SECURITY
We take appropriate technical and organisational security measures to protect your Personal Data against unauthorised access, manipulation, loss and misuse.
All data is processed and saved using the highest security standards. Encryption methods are used when exchanging and saving the data. Our technical and organisational security measures are reviewed on a regular basis and adapted in line with technological advances.


10. YOUR RIGHTS 
In general, you have a right to information about the data we have saved about you as well as a right to correct, remove and object to this data. You have the right to request the deletion of the data, except where there are mandatory reasons precluding such deletion.
